MALIGNED, DEMONIZED & PERSECUTED

This year's Operation: 12 Days of Xmas kicks off on a very serious note.
On December 15, 2009, Win Animal Rights will be represented in the Kings
County courtroom where Fabian Henderson will be sentenced for the crime
of abusing a young female pit bull named Oreo. Fabian Henderson beat
her and threw her off the roof of a 6 story building. As the result of a
plea deal, Henderson was to get off without any jail time. He missed his
sentencing hearing and as a result, he may now receive jail time. We
will see on Tuesday if Oreo will get any justice from the courts.

Meanwhile, the ASPCA (American Society for the Prevention of Cruelty to
Animals), after using Oreo shamelessly for fundraising, finished the job
that Fabian Henderson started, by sentencing Oreo to death by lethal
injection on November 13, 2009. Ed Sayres, CEO of the "A" and Victoria
Wells, the uncertified behaviorist, who had Oreo killed will not be
facing a judge for their crimes. Instead they are planning to execute
another pit bull.

Tonight, that pit bull awaits death in a cage at the "A". His name is
Max. He will be fed a last meal of "premium kibble" (whatever that is)
and tomorrow he will die at the hands of the ASPCA, which has the
audacity to refer to itself as a No Kill Shelter.

The root of the problem is twofold. We have an unskilled, uncertified
"animal behaviorist", Victoria Wells. Whistleblowers at the "A" report
that she has substance abuse issues. It is clear from pictures and
videos that she has problems dealing with certain types of dogs. And we
have a CEO that is arrogant and insensitive not only to the plight of
the animals, but also to his own staff, as he bullies and blackmails
them into submission. His response to questions or criticism is that if
a staffer does not agree with a decision, they are free to leave their
job at the ASPCA. Not to mention his utter disregard for the animal
advocacy constituency.

And on Tuesday, December 15, 2009 at 3:00 PM, this dastardly duo will
claim yet another victim: Max.

Who will fight for Max? Who will mourn Max? Sadly, caring staff at the
ASPCA will mourn him just like they grieved over poor Oreo. We, at Win
Animal Rights, will fight for Max, and for Oreo, and for Bruce, and for
Lucy. We will fight shelters like the ASPCA, not because we want
to......but because WE MUST.

If we allow animal protection organizations to kill pit bulls with
impugnity, their blood would be just as much on our hands as it is on
theirs. If we allow organizations to operate behind a shroud of
indifference, then we are as much to blame as they are.

American Pit Bull Terriers

Their love is like no other; their heart is pure as gold.
Yet while going on a friendly walk, they're faced with stares of cold.
They're so very close to human, in how they act and what they do.
Unless you've known their devoted love, it's impossible to explain to you.
They are greatly more MISUNDERSTOOD than any other breed.
We tend to punish this loyal dog, instead of mankind's deeds.
They are always and forever clowns, with a wish for center stage.
Yet while displaying this sense of humor, most people disengage.
They, oh, so want to make new friends, and run and jump and play.
yet when they happily approach, most people shy away.
Often I've seen children poke, or hop on for a ride.
And when I felt they might get mad, they've only beamed with pride.
I've seen these children yank and pull, with nary a reaction.
Yet media's not interested, unless they've put someone in traction.
They love to snuggle up real close, to give lots of loves and kisses.
Yet they suffer more than any, from unfair prejudices.
What animal do I speak of, whose love is so unique?
If you've truly known one, you know of whom I speak.
There is no creature on this earth who will ever make you merrier.
The animal I do speak of, it's the American Pit Bull Terrier.

A Pit Bulls' Right to Be

I went for a walk the other day,
to clear my head, when along the way.
I came upon a sight to sorry to see,
a beaten pit bull looking up at me.

She had been fought, and lost my guess,
Thrown away like all the rest.
In her eyes, I saw a love so deep,
a deep hardened anger into my soul did creep.

I put the anger aside, and bent down to hold,
this beautiful creature, so lonely and cold.
I knew she was dying, she knew it too,
and she would die in my arms, me saying I love you.

We sat for awhile, looking into each other's eyes,
and no one could hear our sad, sad cries.
With her last little strength, she licked my face,
and then went away with a beautiful grace.

I walked away a different soul,
Anger and hatred would take their toll.
I was so lost in anger and grief,
my life was being stolen, by an invisible thief.

I looked for a purpose, and soon I did see,
I had to fight, for a pit bulls right to be.
Pit bulls are loyal, loving, honest, and true,
and sweet pit bulls, I'll always be fighting for you.

Phoenix case update: Twins to be tried as adults

The 17-year-old twins accused of setting fire to a pit bull puppy
known as Phoenix will be tried as adults, a judge decided Tuesday.

Judge David Ross ruled that Tremayne and Travers Johnson will face
felony animal cruelty charges in Baltimore Circuit Court, allegations
that could send the boys to jail for three years, The Sun's Brent
Jones reports. Attorneys for the twins argued that they were not
properly cared for in the juvenile system after they were placed on
probation for a handgun violation in October 2008.

"Whatever happened to Oreo?"

Let's Ask the ASPCA

Remember back in July when we heard the horrifying story of a 1 year old
female pit bull named Oreo that was thrown off the roof of a six story
building in Brooklyn? 19 year old Fabian Henderson was arrested on
July 31, 2009 and charged with animal cruelty and reckless endangerment
for the action which took place at an earlier date in June. Henderson
has entered a guilty plea and will be sentenced in Kings County Criminal
Court on December 1, 2009. Look for an action alert later this month
with the details on the court appearance and contact information for the
Judge and the D.A.'s office.

We have good news and bad news about Oreo. The good news is that
despite massive injuries, Oreo was rescued by the ASPCA in a high
profile case that was reported by several media outlets. Oreo underwent
extensive surgery to put her front legs back together and since then,
she has been at the ASPCA. No doubt the road to recovery was painful
and difficult for Oreo because of the extent of her injuries.

The bad news is that Oreo is still at the ASPCA and no one seems to be
able to tell us why she is not in a foster home or a forever home. Many
have called wanting to adopt her. According to court reports, Oreo was
injured in mid-June......some 5 months or more ago. The longer she
stays in a cage, the harder it will be to rehome or rehabilitate her.
Oreo has been through enough, she deserves a chance.

We know that you are busy, but your call and/or e-mail right now is
vitally important so that Oreo is not forgotten. Hand written letters
take longer, but are given more weight. Please take a minute to help
poor Oreo, who was treated so cruelly and who deserves a chance to live
a normal life with companions who will love her and help her get over
her past trauma and abuse. Posting this appeal to blogs, myspace,
twitter or any other social networking sites will be a huge help.

So, let's ask the ASPCA....."Whatever happened to Oreo?" and "Why isn't
she in a foster or forever home by now?". Do your best to get directly
to Ed Sayres (the people answering the phone will try to reroute your
call to the press department or humane law enforcement) as he is the
only one who has the power to make the decision to help Oreo. I am sure
many of you are supporters of the ASPCA. Please mention that when you call.

The Pit-Bull Problem

America's most-maligned dog wants to be sweet and docile, but well-meaning humans mess it all up.

A 10-acre stretch of land just outside Los Angeles is pit-bull Nirvana. It's called Villalobos Rescue Center and it's run by Tia Maria Torres, an unabashed pit-bull lover. Torres has found homes for thousands of pits since the rescue opened its doors 15 years ago. Some of these animals were abandoned. Some were shelter dogs slated for euthanasia. Others were confiscated in drug busts or fighting rings. And some—like Mouse, a small white pit bull—are victims of nature, the so-called Hurricane Katrina dogs of New Orleans.

It's a 24/7 job, but Torres gets help from a posse of volunteers, her four children, and six ex-cons, who she calls her "pit bulls on legs." Her work is chronicled in a new six-part documentary, Pit Bulls and Parolees, airing on Animal Planet, the first of which premiered on Friday night. You'd have to carry a cold heart to not feel something for what these dogs have endured.

But I have a problem with pit bulls. And it has more to do with the two-legged creatures holding their leashes (if there is a leash).

Because of their sheer numbers—estimates show that there are anywhere from 5 million to 10 million pit-bull-type dogs in the U.S. today, out of about 61 million total dogs—pits have become the dog du jour for a lot of people, not just gangbangers and wannabe thugs who use a pit as proxy for toughness. About 20 percent of dogs in ASPCA shelters are pit mixes.

I've seen those who adopt these dogs for all the wrong reasons. The fearful might get a pit because they want a great guard dog. (Pits make lousy guard dogs. A well-bred pit is just too human-friendly to protect your property.) Some get a pit because Rachael Ray has one and they want to rescue a dog. (Why didn't you take up cooking instead of getting a dog that you know nothing about?) And the trendiest pet owners spend thousands of dollars for a "blue" pit because the dogs are rare. (No, they aren't, and you just got swindled by an unethical breeder who contributed to the overpopulation problem.) But pets aren't purses, and people who jump into pit-bull ownership without the requisite training and education can often do more harm than good. That's why when I see a pit off-leash and I'm walking Turk, my 20-pound schnoodle, I'm scared.

Let's face it: pit bulls are public enemy No. 1. That's quite a comedown for a pup once considered "America's dog." They were owned by the likes of Helen Keller and Teddy Roosevelt, and when I was a kid, a wiry American pit-bull terrier named Sam endured the indignity of being called a "horsy" as he pulled me around in a wagon on an upstate New York farm. But in talking with pit-bull experts, it's clear that some current owners are too easy to spook, are too ill-informed, and have unrealistic expectations of what pit bulls can do.

Torres knows all about the pit bull's people problem. "Oh, my God, I see it all the time," she says. "Some of these people are completely clueless. They get a pit and then they want to get rid of it if it grabs and shakes a toy and barks. They don't understand why it loves everybody, but scraps with dogs. It's insane. And it's hurting the pit bull."

Some of the so-called pit problems are directly linked to the dog's history. Today's pit bull can trace its roots back to bulldogs, which were used for bull baiting, a gruesome spectacle in which the dogs would try to pin a tied bull by latching on to its nose. When bull baiting was outlawed, these bulldogs were then bred with small terriers, feisty dogs known for their drive. The end result was the original pit bull, a "canine gladiator" bred specifically for dog-on-dog combat.

Pit bulls burned in East Bakersfield, $5,000 reward offered

A local case of animal cruelty is gaining national attention after two
pit bull puppies were burned in East Bakersfield. One of the dogs has
a facebook page, which shows both puppies recovering from horrific
burns.

The Animal Control department doesn't have any leads but a $5,000
reward is being offered for information.

Charlie is the 6-month-old pit bull Animal Control says was
intentionally burned Oct. 15. Another pit bull, named Smokey, was
found in July in the same area with similar burns.

Now both dogs are drawing attention from people as far away as
Pennsylvania on Facebook.

Vick declines invitation to see his pitbulls

Michael Vick will stay away from former dogs this weekend.
CAPTIONGetty ImagesA pit bull advocacy group in Oakland, Calif., says Michael Vick has declined an invitation to visit eight of his former dogs this weekend when the Philadelphia Eagles are in town to play the Oakland Raiders.


The group BAD RAP (Bay Area Doglovers Responsible About Pitbulls) told The Associated Press it extended the invitation through the Eagles to Vick last week to view his former dogs that were part of the dog fighting operation at Bad Newz Kennels in southeastern Virginia.

BAD RAP co-founder Tim Racer said the group picked a location that would have allowed Vick to view the dogs from behind a window at a distance that satisfied the conditions of his parole that bar him from being near animals.

Racer said the Eagles informed him Wednesday that Vick would decline the offer. An e-mail sent to an Eagles spokesman was not immediately returned.

Ruling on "pit bull" revives debate on Denver's ban

On Monday, an administrative judge ruled that Denver Animal Care and Control must remove the pit bull breed label from Kevin O'Connell's dog.

On Friday, O'Connell, 40, of Thornton, and his boxer-mix Dexter celebrated the ruling.

O'Connell's attorney, Jennifer Edwards of The Animal Law Center, said the reversal could be a first step toward combating the controversial ordinance that bans pit bulls from Denver.

"This ruling absolutely disqualifies Denver in having any expertise in breed determining," Edwards said.

Breed determination, Edwards said, is the crux of the city's ability to enforce its ban on pit bulls.

During a July business trip, O'Connell left Dexter with friends who live in Denver. Animal control was called to the residence on an unrelated incident and saw Dexter in the backyard.

Officers suspected Dexter of being a pit bull and seized him. A few days later, the dog was subjected to a breed examination, during which he was found to have a majority of pit-bull characteristics.

O'Connell challenged the finding.

Animal Control director Doug Kelley said that this is not the first time a classification has been lifted and it is not uncommon for dog owners to contest exam results.

"This is the example of why we have this process in place," Kelley said, "and this outcome only demonstrates that it is working."

Once a confiscated dog is labeled a pit bull, it can no longer live in or visit Denver. Dogs in violation may be relocated or euthanized.

The exam panel is made up of two animal-control officers and a veterinarian technician, each of whom completes an exam of the dog to determine its breed characteristics, Kelley said.

Edwards, who presented testimony from American Kennel Club judges and professional dog handlers during the hearing, said the city's process is inadequate and called the examiners unqualified. She said this ruling could lead to more dog owners coming forward to challenge the results of exams.

But Kelley said city dog examiners receive special training and field experience in determining a dog's breed based on its physical characteristics and traits.

Bronx Dogfighting Ring, Please Attend Court Proceedings

(Bronx, NY) Allegedly run by defendant Alexander Estephane, a neighborhood dogfighting ring was raided in June 2008 by a coordinated team of New York and New Jersey authorities who arrested seven men, including a corrections officer, and rescued 16 pit bulls at the scene. Rescue came too late for one embattled dog who died a short time later despite veterinary intervention. The men face felony and misdemeanor charges of animal fighting as well as gambling. Locals are encouraged to support their community and the prosecution by attending court proceedings.

Dog Dragged to Death from a Bicycle-Action Alert!

(Carter County, Okla.) On March 17, Antonio Ray, 37, allegedly dragged a pit bull from his bicycle through the Ardmore, Oklahoma city streets. Many witnesses called police, and one took a picture of the incident using his cell phone. A witness described the horrifying scene, “[The dog’s] arms were behind it, its chest was on the ground and there were streaks of blood. And we went back afterwards and measured it, four-tenths of a mile he dragged this dog. The pads of its feet were gone and it was laying in a pool of blood." Authorities took the tortured dog to a nearby animal shelter, but he died before he could be treated.

Police arrested Ray and charged him with animal cruelty. A police press release details the incident. Court records show Ray has a history of domestic abuse, drug offenses, weapons offenses and DUI.

Take Action!
Please write a polite letter to Assistant District Attorney Brad Noland, thanking him for charging Ray with felony animal cruelty and encouraging him to seek the maximum penalty upon conviction.

Eagles' animal-welfare blitz package

A month after the controversial signing of convicted dogfighter
Michael Vick, the Eagles yesterday circulated a draft plan to
animal-rights groups that calls for an immediate, widespread campaign
to combat animal abuse in Philadelphia.

According to the proposal, obtained by The Inquirer, the team plans a
range of new animal-welfare activities, including deployment of Eagles
players and cheerleaders to schools and community events and a mobile
animal-care van to at-risk areas. The van could be called the Pet
Mobile. The team also plans to print trading cards that feature Eagles
players and their pets.

Grants and public-service announcements would promote the adoption of
homeless animals, encourage citizens to report animal abuse, and
assist fund-raising to expand spaying and neutering services.

The Eagles were widely criticized by animal-welfare advocates -
several of them angry Eagles fans who turned in season tickets and
tossed their team jerseys - following news of the Vick signing.

Why breed specifc regulation will not solve animal cruelty

Many of the advocates of Breed Specific Legislation against bully
breeds overlook that it is the culture of cruelty, and not the
availability of pit bulls and other bully breeds that makes dog
fighting possible.

The bird world has recently provided a model of what will happen if
every community passed breed specific legislation. Once pit bulls
become illegal in a community, dog fighting rings will move onto some
other, "acceptable" dog.

Just a few months ago in Shelton, Connecticut, over 150 canaries and
finches were seized as part of a bird fighting ring raid. Nineteen
people were arrested, and $8,000 in cash was seized during the raid.
Unlike fighting Roosters, canaries and finches are easily maintained
in tight quarters.

SPCA busts East Germantown dog-fighting ring

Officers from the Pennsylvania SPCA yesterday uncovered a dog-fighting
ring at an East Germantown house and rescued several badly injured pit
bulls found there.

Following a tip to an animal-cruelty hotline, the officers discovered
two dead dogs and five others at the house, in the 200 block of East
Bringhurst Street.

Three men, including the property owner and the alleged ringleader,
face charges.

The bust came 10 days after the Philadelphia Eagles signed quarterback
Michael Vick, who served 18 months in federal prison for running a
dog-fighting operation. He has pledged to speak out on the issue,
casting a spotlight on the problem of dog-fighting in the city.

Today, the Eagles plan to hold a summit of area animal-welfare groups
at the NovaCare Complex, the team's South Philadelphia training
facility. Vick is not expected to attend.

New law for convicted dog fighters

CHICAGO (STNG) -- A new law signed by Gov. Pat Quinn this week
prohibits convicted dog fighters from owning unsterilized or vicious
dogs, making it more difficult for offenders to return to the illegal
activity once they have served their time.
According to Best Friends Animal Society, the law is the first of its
kind in the United States. It amends the State of Illinois Criminal
Code of 1961 to make it a misdemeanor for a convicted dog fighter to
own unsterilized dogs or dogs that have been deemed vicious by a
court. This includes any unspayed or unneutered dog or puppy older
than 12-weeks-old, or irrespective of whether the dog has been spayed
or neutered, any dog that has been determined to be a vicious dog
under Section 15 of the Animal Control Act.

“This will give law enforcement more tools to crack down on people who
fight dogs,” Ledy VanKavage, senior legislative analyst for Best
Friends said. “It will also have the effect of helping lessen the
likelihood that convicted dog fighters, once they are released from
prison, go back into the breeding business.”

Sadly, Otis still sits at the shelter, confined to a cage, yearning to be safe and back in his loving home. Cruelly tasered twice by Lakewood, OH, police when he slipped out of the door to his home and determined to be a vicious pitbull, Otis’ fate is still to be determined.

If you’re not familiar, read the original story HERE, watch the raw footage video that was released of Otis being tasered by the police. It’s hard to watch and listen to, the cops calling Otis as he barks and backs away defensively and then is tasered, ensnared by a catch pole, dragged along the ground and then tasered again.

Although I don’t condone, I give the cops the benefit of the doubt on the first tasering, but it seems the only reason Officer Terry Lowther didn’t shoot Otis, although he did pull his gun to do so, was because he was concerned that a bullet might ricochet and hit something other than the dog. Once Otis had been tasered and was on the catch pole, there was no reason whatsoever that he had to be tasered again!! He was no threat to anyone!!

Otis’ owner, Daniel Kier, bears and accept some of the responsibility for what happened, he fell asleep on Saturday morning and the screen door wasn’t properly latched, allowing Otis to escape. I imagine the guilt he feels is tremendous! As dog owners, accidents to happen, dogs do escape even the most responsible of owners. And no, Otis was not tagged either, again something Keir will have to live with, especially if Otis can’t be saved.

On Monday, Otis’ fate may be decided. Is he a vicious pitbull or a scared boxer that just was taking a taste of freedom, cornered by police and animal control?

Now the only way the Daniel get to see Otis is to visit him at the shelter where he is incarcerated and will stay until his fate is decided. On Thursday evening he made just such a visit and a new station catch Daniel and Otis’ visit. They filmed the interaction from a distance so as not to intrude, it is not staged. Take a look at how vicious this dog is! Yeah, really scary.



“This is him” Kier told Fox 8, there exclusively to witness the interaction. “this is my vicious dog” he said sarcastically.

The interaction was neither staged nor rehearsed. Fox 8 cameras stayed behind a fence so as not to interfere with the interaction in any way. What we wanted to see was genuine.

Otis did not even seem to notice we were there.

The two played ‘fetch’ with a stuffed frog Kier brought to the shelter. Otis’ tongue hung out as he bounced around the lot clearly enjoying the interaction. During a 20 minute visit the dog didn’t bark even once.

Kier says the only time his dog seems to get uneasy is when he sees the warden.

Holding him in his arms, Kier says he cannot believe the amount of support he has gotten from all over the world, as far away as South Africa and Australia.

“I never wanted to be famous for something like this” he said. “Its not about be, though, its all about him, all about him” (Fox 8)

You can hear Otis whimper as Daniel walks away from him.

There is a petition, which as of this writing, has over 5000 signatures, many with pleas to spare Otis’ life, asking the he be allowed to return home with Daniel and saying what they think of the officer’s actions.

Does Otis fit the Ohio statute pertaining to “vicious” dogs? You decide;

Ohio allows statutory definition of vicious dog – City of Toledo v. Tellings, 871 N.E.2d 1152, 114 Ohio St.3d 278 (Ohio 2007)

[30]{13} “(4)(a)’Vicious dog’ means a dog that, without provocation and subject to division (A)(4)(b) of this section, meets any of the following:
[31]{14} “(i) Has killed or caused serious injury to any person;
[32]{15} “(ii) Has caused injury, other than killing or serious injury, to any person, or has killed another dog.
[33]{16} “(iii) Belongs to a breed that is commonly known as a pit bull dog. The ownership, keeping, or harboring of such a breed of dog shall be prima-facie evidence of the ownership, keeping, or harboring of a vicious dog.”
[34]{17} R.C. 955.22(A) states:

[35]{18} “As used in this section,’dangerous dog’ and ‘vicious dog’ have the same meanings as in section 955.11 of the Revised Code.”

Based on this, it doesn’t seem to me that he can be declared a vicious dog unless these imbeciles continue to insist that Otis, an obvious boxer, is a pitbull, a “breed” banned by Lakewood, OH and without paperwork saying otherwise, they may just do that… and be able to get away with it!!

Oh, and Daniel also hasn’t been allowed to have a DNA test done on Otis either. Wonder if someone’s afraid that might bolster that Otis is a boxer??

The video the police released to bolster their story shows the dog writhing in pain and agony and it also seems to be backfiring on them. Dog lovers are outraged and say the officer went way overboard, it was animal cruelty and abuse. There is also a controversy about the breed of dog.
Pitbulls are a banned breed in Lakewood, OH and police and animal warden say that Otis is a pitbull or part pitbull. Now Otis, who escaped his home unknown to his sleeping owner on Saturday morning, sits in a cage, scared and shaking, his fate undecided.
I guess we can at least be thankful that the police%u2019s first response was not to pull a gun and shoot the dog and as painful as it is to watch, even though I dont agree, tasering him was better than the alternative but I certainly didnt see a need for the dog, who was on a catch pole and had been dragged along the ground, to be tasered a second time. This was clearly a case of overzealous officers. To me, the dog just looked scared and defensive, not aggressive in the first place.
And of course its no surprise the the department and animal control is backing the officers, both for the cruel tasering as well as calling the dog a pitbull. Being banned, labeling Otis a pitbull is practically a death sentence for the dog.

Dog owners continue to challenge confiscation of their pets under Miami-Dade's pit bull ban.

In Ordinance No. 89-22, the county bans all dogs that "substantially conform" to American Kennel Club standards for American Staffordshire Terriers or Staffordshire Bull Terriers or United Kennel Club standards for American Pit Bull Terriers.

There is a hearing set Friday, July 31, 2009 to challenge the confiscation of alleged pit bull dogs, Carlos McLiberty and Baby Girl. Please plan to attend!

In March, 2009, in a similar challenge a hearing officer refused to enforce the ban against the alleged pit bull dog, saying it was too vague. That case was instigated by Miami Coalition Against BSL, an organization dedicated to ending the pit bull ban.

Dahlia Canes, founder of Miami Coalition Against BSL, says her organization plans to continue to urge owners whose dogs are confiscated under this ban to raise legal challenges.

She said "This is an extremely important step towards the removal of BSL /Pit Ban in Miami-Dade County. [Public] support is most appreciated by the over 70,000 Pitties/Staffies and mixes ... residing in Miami-Dade County. Remember... this is not only about Pit Bulls, as Breed Specific Legislation criminally discriminates against over 75 targeted breeds."

Canes continued, "This ridiculous and inhumane ordinance has been here since 1989 and it's time to go! It is solely responsible for the confiscation and killing of thousands of innocent dogs. Family members, who are left with hefty fines ...grieving over their loss... without a logical explanation! "

Canes asks that supporters planning to attend the hearing "wear your MCABSL t-shirts or other attire showing your support for our cause. By all means be courteous and patient, as this 101 crash course on Dade and the legal arena for BSL, will surely be enlightening. Let's Rock The House For Them!"

Police Say its "OK" to Taser Family Pet

LAKEWOOD, OH (WOIO) - A family dog tasered by Lakewood police will remain at an Animal Shelter until his owner's early August court appearance.

Two women heard Otis the dog barking Saturday morning around 8:30AM and looked out their apartment window only to see the pup surrounded by several police officers.

The officers tasered Otis "like he was a grizzly bear," says witness Christina MacDonald.

MacDonald also said that "the dog was backing up defensively, as if he was saying stay away from me. He wasn't being aggressive in any way."

Otis' owner, Daniel Kier, claims his dog is "a Boxer, not a Pit Bull." The animal warden agrees with local authorities and claims the dog looks as though he has Pit Bull in its blood.

Lakewood Police issued a press release that stated the dog was aggressive towards the officers and stand behind the decision to taser the dog.

According to Captain Gary Stone, the officer "observed an aggressive pit bull on the sidewalk, it charged at the officer and then stopped five feet away. The officer was then able to deploy his taser which incapacitated the animal."

Kier was cited for having a dangerous and vicious animal and for letting Otis run loose. He's scheduled to appear in court on August 4th at 9AM.

Otis will remain at the shelter until that time.

However, there is a vicious dog hearing for Otis at Lakewood Municipal Court at 3PM tomorrow afternoon. Pit Bulls are banned in the City of Lakewood.

Controversy surrounding Stu the dog spurs proposed change in L.A. animal law

After almost four years in custody, ten year-old Stu remains in legal limboIn their first meeting since the Court of Appeals ruled the death sentence against the long-incarcerated dog Stu could stand, the Board of Animal Services Commissioners on Monday proposed changing L.A.'s Municipal Code to allow the Board to overrule the General Manager's verdict of death against dogs the Animal Services department has determined to be dangerous, even after the appeals process has been exhausted, if new evidence becomes available.

Board Vice President Kathy Riordan pushed for strong action from the Board, both in a last-ditch attempt to ensure that ten year-old Stu not be killed in the wake of the Appeals Court decision, which would allow L.A. Animal Services to euthanize the dog as early as July 23rd, and to help avoid similar situations from occurring again.

Said Riordan, "Hopefully we can fix some things for future dogs with this."

Riordan introduced the motion after a lengthy closed session which followed a contentious start to Monday's meeting that was dominated by questions from members of the community about Stu's fate. Several people spoke in the senior dog's defense, including Orange County veterinarian Dr. Paula Terifaj, who asserted that although in her practice she has been bitten several times, occasionally severely, it is not customary to classify dogs who bite when fearful or in pain as dangerous. The single bite incident in which Stu was involved took place when the dog had been injured in a fight with another dog. The bite victim had attempted to put a harness over the dog's injured ear, an act that one expert said had inadvertently provoked the dog to bite.

Dr. Terifaj also pointed out that by the city's own established criteria for determining dogs as dangerous, Stu did not qualify when personally assessed by Dr. Richard Polsky, the animal behavior specialist who helped formulate the criteria over twenty years ago.

As the City Attorney proposed going into closed session, during which members of the public would not be present, Commissioner Archie Quincey initially objected, saying, "There are quite a few things I would like to say regarding this case that I think the public should hear. These are important issues and we seem not to be able to get any results."

Quincey went on to point out that despite repeated requests from the Board that Assistant General Manager Linda Barth provide all records related to the case, "We don't have them."

"Where are the records?"

Quincey, who brings thirty years of L.A. animal control experience to his role as Commissioner, pointed out, as he has done in previous Board meetings, that multiple discrepancies and omissions exist in the the incomplete records that the Department has provided.

"The bite occurred on August 12 and the dog showed up in the shelter on September 15." But, Quincey said, the records don't show how the dog came to be in City custody. "Where was the dog for thirty-four days? Officer Marino said the dog was impounded for a leash violation -- [but] no one will tell us how the dog came to be in the shelter. And then the next day the victim files the [bite] report. That is mighty coincidental!"

Since the Department could not document how Stu came to be in the shelter, when he had been housed in a locked kennel on owner Jeff de la Rosa's property, Quincey said, "As far as I'm concerned, the dog was brought into the City kennel illegally."
