MALIGNED, DEMONIZED & PERSECUTED

This year's Operation: 12 Days of Xmas kicks off on a very serious note.
On December 15, 2009, Win Animal Rights will be represented in the Kings
County courtroom where Fabian Henderson will be sentenced for the crime
of abusing a young female pit bull named Oreo. Fabian Henderson beat
her and threw her off the roof of a 6 story building. As the result of a
plea deal, Henderson was to get off without any jail time. He missed his
sentencing hearing and as a result, he may now receive jail time. We
will see on Tuesday if Oreo will get any justice from the courts.

Meanwhile, the ASPCA (American Society for the Prevention of Cruelty to
Animals), after using Oreo shamelessly for fundraising, finished the job
that Fabian Henderson started, by sentencing Oreo to death by lethal
injection on November 13, 2009. Ed Sayres, CEO of the "A" and Victoria
Wells, the uncertified behaviorist, who had Oreo killed will not be
facing a judge for their crimes. Instead they are planning to execute
another pit bull.

Tonight, that pit bull awaits death in a cage at the "A". His name is
Max. He will be fed a last meal of "premium kibble" (whatever that is)
and tomorrow he will die at the hands of the ASPCA, which has the
audacity to refer to itself as a No Kill Shelter.

The root of the problem is twofold. We have an unskilled, uncertified
"animal behaviorist", Victoria Wells. Whistleblowers at the "A" report
that she has substance abuse issues. It is clear from pictures and
videos that she has problems dealing with certain types of dogs. And we
have a CEO that is arrogant and insensitive not only to the plight of
the animals, but also to his own staff, as he bullies and blackmails
them into submission. His response to questions or criticism is that if
a staffer does not agree with a decision, they are free to leave their
job at the ASPCA. Not to mention his utter disregard for the animal
advocacy constituency.

And on Tuesday, December 15, 2009 at 3:00 PM, this dastardly duo will
claim yet another victim: Max.

Who will fight for Max? Who will mourn Max? Sadly, caring staff at the
ASPCA will mourn him just like they grieved over poor Oreo. We, at Win
Animal Rights, will fight for Max, and for Oreo, and for Bruce, and for
Lucy. We will fight shelters like the ASPCA, not because we want
to......but because WE MUST.

If we allow animal protection organizations to kill pit bulls with
impugnity, their blood would be just as much on our hands as it is on
theirs. If we allow organizations to operate behind a shroud of
indifference, then we are as much to blame as they are.

American Pit Bull Terriers

Their love is like no other; their heart is pure as gold.
Yet while going on a friendly walk, they're faced with stares of cold.
They're so very close to human, in how they act and what they do.
Unless you've known their devoted love, it's impossible to explain to you.
They are greatly more MISUNDERSTOOD than any other breed.
We tend to punish this loyal dog, instead of mankind's deeds.
They are always and forever clowns, with a wish for center stage.
Yet while displaying this sense of humor, most people disengage.
They, oh, so want to make new friends, and run and jump and play.
yet when they happily approach, most people shy away.
Often I've seen children poke, or hop on for a ride.
And when I felt they might get mad, they've only beamed with pride.
I've seen these children yank and pull, with nary a reaction.
Yet media's not interested, unless they've put someone in traction.
They love to snuggle up real close, to give lots of loves and kisses.
Yet they suffer more than any, from unfair prejudices.
What animal do I speak of, whose love is so unique?
If you've truly known one, you know of whom I speak.
There is no creature on this earth who will ever make you merrier.
The animal I do speak of, it's the American Pit Bull Terrier.

A Pit Bulls' Right to Be

I went for a walk the other day,
to clear my head, when along the way.
I came upon a sight to sorry to see,
a beaten pit bull looking up at me.

She had been fought, and lost my guess,
Thrown away like all the rest.
In her eyes, I saw a love so deep,
a deep hardened anger into my soul did creep.

I put the anger aside, and bent down to hold,
this beautiful creature, so lonely and cold.
I knew she was dying, she knew it too,
and she would die in my arms, me saying I love you.

We sat for awhile, looking into each other's eyes,
and no one could hear our sad, sad cries.
With her last little strength, she licked my face,
and then went away with a beautiful grace.

I walked away a different soul,
Anger and hatred would take their toll.
I was so lost in anger and grief,
my life was being stolen, by an invisible thief.

I looked for a purpose, and soon I did see,
I had to fight, for a pit bulls right to be.
Pit bulls are loyal, loving, honest, and true,
and sweet pit bulls, I'll always be fighting for you.

Why breed specifc regulation will not solve animal cruelty

Many of the advocates of Breed Specific Legislation against bully
breeds overlook that it is the culture of cruelty, and not the
availability of pit bulls and other bully breeds that makes dog
fighting possible.

The bird world has recently provided a model of what will happen if
every community passed breed specific legislation. Once pit bulls
become illegal in a community, dog fighting rings will move onto some
other, "acceptable" dog.

Just a few months ago in Shelton, Connecticut, over 150 canaries and
finches were seized as part of a bird fighting ring raid. Nineteen
people were arrested, and $8,000 in cash was seized during the raid.
Unlike fighting Roosters, canaries and finches are easily maintained
in tight quarters.

Study: Chihuahuas most likely to bite

This country celebrates National Dog Bite Prevention Week every year in May.

During that time various organizations post helpful tips on how to protect
yourself and your children from being bitten, along with a variety of
graphic stories about individuals who had been attacked by dogs.
Generally, we see nothing about the simple prevention methods of training
and socializing dogs, or training children to interact safely with them.

For the last 20 years or so the most often selected dog bite prevention
method has been to ban certain breeds or types of dogs. Anyone with any
understanding of dog behavior will know that banning dogs has no effect on
reducing bite incidents for the simple reason that all dogs, given the
"right" set of circumstances, will bite. The only sure-fire way to prevent
all dog bites is to eliminate all dogs from our society. But some are not
satisfied with this method, and believe that there must be a better
solution; one that solves the problem of poor communication between dogs
and humans, and eliminates the risk of bites.

Since the majority of people do not want to live their lives without the
company of dogs, it was deemed necessary to gather facts so that a more
intelligent solution could be devised.

Colorado had instituted some of the most draconian laws that banned any
dog that bore even the slightest resemblance to so-called "pit bull" types
in a concerted, but failed, attempt to eliminate all dog bites. The
Coalition for Living Safely With Dogs and the Colorado Veterinary Medical
Association joined together to conduct a two-year study about how likely
any given dog is to bite, as part of their effort to overturn
breed-specific legislation already passed in some states and many cities
and prevent its imposition in additional places.

Their major finding so far is that all dogs will bite, and that
circumstances under which the bite occurred are more pertinent than the
breed or type of dog involved. This is good news for dogs, in that the
study poked big holes in the theory that bites could be prevented simply
by banning certain breeds or types of dogs. It also contained bad news in
that the situation was shown to require far more sophisticated and
far-reaching methods than simply banning one or more dogs.

Among facts discovered or confirmed are that the breed most likely to bite
a veterinarian or groomer is the Smooth-Coat Chihuahua. It also confirmed
that, refuting the myth that Pit Bull dogs can perform the most severe
bites, the most damaging bites were administered by Lhasa Apsos. And to
prove the egalitarian nature of dogs, about 40 percent of bites were
inflicted by mutts and "designer dogs," slightly more than the percentage
they make up in the general dog population.

The most common factor in dog bite incidents was that the dog was running
loose and unsupervised, specifically while the dog was engaged in
dog-on-dog aggression, or while exhibiting aggression protecting property,
or during fear-based aggression.

So the true simple solution is not to ban certain dogs, but rather to
require that no dog be allowed to roam loose.

New Hampshire has an exemplary dog control law, in that it requires all
dogs to be confined on their owner's property and, when off its owner's
property, to be under the direct control of an adult. This law was passed
back in the early 1980s, and is a direct and major contributor to the
relatively low number of bite incidents in this state, as well as to the
reduction in litters of unwanted puppies.

Almost every municipality in the state has accepted this law. If yours has
not, perhaps you should inquire as to why not? Most bites occur in the
dog's home, and most involve aggression while the dog is protecting its
property. Children are bitten more often, but much less severely, than
adults.

Generally these bites occur because children are not taught how to
interact with dogs, or are left alone and unsupervised with one or more
dogs. Children must be taught not to attempt to remove their dog's food or
toys, and not to physically abuse dogs while in play. Dogs need to be
socialized and trained so that their behavior is reliable in all
situations.

Otis the Boxer was Tasered and now he needs your HELP!!

Otis is a white boxer who lives in the Lakewood, Ohio area where pit bulls are banned. When Otis escaped his house through a screen, the police found him on the street and tasered him not once, but twice. Please do NOT watch the video if you cannot handle a poor defenseless creature crying and writhing in pain. What the video will show you is a white boxer boy, barking and wiggling his tail. Not once does it show him lunging viciously or attacking or biting anyone or even trying to do any of those things. The pictures will also show you he is clearly a boxer, like my collective boxer kids Wilshire, Chance, Sister, Stella and Oscar.

Please sign the petition because Otis is being held as a possible vicious dog until an upcoming hearing which has already been postponed because the police involved were not available.

Sadly, Otis still sits at the shelter, confined to a cage, yearning to be safe and back in his loving home. Cruelly tasered twice by Lakewood, OH, police when he slipped out of the door to his home and determined to be a vicious pitbull, Otis’ fate is still to be determined.

If you’re not familiar, read the original story HERE, watch the raw footage video that was released of Otis being tasered by the police. It’s hard to watch and listen to, the cops calling Otis as he barks and backs away defensively and then is tasered, ensnared by a catch pole, dragged along the ground and then tasered again.

Although I don’t condone, I give the cops the benefit of the doubt on the first tasering, but it seems the only reason Officer Terry Lowther didn’t shoot Otis, although he did pull his gun to do so, was because he was concerned that a bullet might ricochet and hit something other than the dog. Once Otis had been tasered and was on the catch pole, there was no reason whatsoever that he had to be tasered again!! He was no threat to anyone!!

Otis’ owner, Daniel Kier, bears and accept some of the responsibility for what happened, he fell asleep on Saturday morning and the screen door wasn’t properly latched, allowing Otis to escape. I imagine the guilt he feels is tremendous! As dog owners, accidents to happen, dogs do escape even the most responsible of owners. And no, Otis was not tagged either, again something Keir will have to live with, especially if Otis can’t be saved.

On Monday, Otis’ fate may be decided. Is he a vicious pitbull or a scared boxer that just was taking a taste of freedom, cornered by police and animal control?

Now the only way the Daniel get to see Otis is to visit him at the shelter where he is incarcerated and will stay until his fate is decided. On Thursday evening he made just such a visit and a new station catch Daniel and Otis’ visit. They filmed the interaction from a distance so as not to intrude, it is not staged. Take a look at how vicious this dog is! Yeah, really scary.



“This is him” Kier told Fox 8, there exclusively to witness the interaction. “this is my vicious dog” he said sarcastically.

The interaction was neither staged nor rehearsed. Fox 8 cameras stayed behind a fence so as not to interfere with the interaction in any way. What we wanted to see was genuine.

Otis did not even seem to notice we were there.

The two played ‘fetch’ with a stuffed frog Kier brought to the shelter. Otis’ tongue hung out as he bounced around the lot clearly enjoying the interaction. During a 20 minute visit the dog didn’t bark even once.

Kier says the only time his dog seems to get uneasy is when he sees the warden.

Holding him in his arms, Kier says he cannot believe the amount of support he has gotten from all over the world, as far away as South Africa and Australia.

“I never wanted to be famous for something like this” he said. “Its not about be, though, its all about him, all about him” (Fox 8)

You can hear Otis whimper as Daniel walks away from him.

There is a petition, which as of this writing, has over 5000 signatures, many with pleas to spare Otis’ life, asking the he be allowed to return home with Daniel and saying what they think of the officer’s actions.

Does Otis fit the Ohio statute pertaining to “vicious” dogs? You decide;

Ohio allows statutory definition of vicious dog – City of Toledo v. Tellings, 871 N.E.2d 1152, 114 Ohio St.3d 278 (Ohio 2007)

[30]{13} “(4)(a)’Vicious dog’ means a dog that, without provocation and subject to division (A)(4)(b) of this section, meets any of the following:
[31]{14} “(i) Has killed or caused serious injury to any person;
[32]{15} “(ii) Has caused injury, other than killing or serious injury, to any person, or has killed another dog.
[33]{16} “(iii) Belongs to a breed that is commonly known as a pit bull dog. The ownership, keeping, or harboring of such a breed of dog shall be prima-facie evidence of the ownership, keeping, or harboring of a vicious dog.”
[34]{17} R.C. 955.22(A) states:

[35]{18} “As used in this section,’dangerous dog’ and ‘vicious dog’ have the same meanings as in section 955.11 of the Revised Code.”

Based on this, it doesn’t seem to me that he can be declared a vicious dog unless these imbeciles continue to insist that Otis, an obvious boxer, is a pitbull, a “breed” banned by Lakewood, OH and without paperwork saying otherwise, they may just do that… and be able to get away with it!!

Oh, and Daniel also hasn’t been allowed to have a DNA test done on Otis either. Wonder if someone’s afraid that might bolster that Otis is a boxer??

The video the police released to bolster their story shows the dog writhing in pain and agony and it also seems to be backfiring on them. Dog lovers are outraged and say the officer went way overboard, it was animal cruelty and abuse. There is also a controversy about the breed of dog.
Pitbulls are a banned breed in Lakewood, OH and police and animal warden say that Otis is a pitbull or part pitbull. Now Otis, who escaped his home unknown to his sleeping owner on Saturday morning, sits in a cage, scared and shaking, his fate undecided.
I guess we can at least be thankful that the police%u2019s first response was not to pull a gun and shoot the dog and as painful as it is to watch, even though I dont agree, tasering him was better than the alternative but I certainly didnt see a need for the dog, who was on a catch pole and had been dragged along the ground, to be tasered a second time. This was clearly a case of overzealous officers. To me, the dog just looked scared and defensive, not aggressive in the first place.
And of course its no surprise the the department and animal control is backing the officers, both for the cruel tasering as well as calling the dog a pitbull. Being banned, labeling Otis a pitbull is practically a death sentence for the dog.

This was clearly a case of overzealous officers. To me, the dog just looked scared and defensive, not aggressive in the first place.
And of course its no surprise the the department and animal control is backing the officers, both for the cruel tasering as well as calling the dog a pitbull. Being banned, labeling Otis a pitbull is practically a death sentence for the dog.

Dog owners continue to challenge confiscation of their pets under Miami-Dade's pit bull ban.

In Ordinance No. 89-22, the county bans all dogs that "substantially conform" to American Kennel Club standards for American Staffordshire Terriers or Staffordshire Bull Terriers or United Kennel Club standards for American Pit Bull Terriers.

There is a hearing set Friday, July 31, 2009 to challenge the confiscation of alleged pit bull dogs, Carlos McLiberty and Baby Girl. Please plan to attend!

In March, 2009, in a similar challenge a hearing officer refused to enforce the ban against the alleged pit bull dog, saying it was too vague. That case was instigated by Miami Coalition Against BSL, an organization dedicated to ending the pit bull ban.

Dahlia Canes, founder of Miami Coalition Against BSL, says her organization plans to continue to urge owners whose dogs are confiscated under this ban to raise legal challenges.

She said "This is an extremely important step towards the removal of BSL /Pit Ban in Miami-Dade County. [Public] support is most appreciated by the over 70,000 Pitties/Staffies and mixes ... residing in Miami-Dade County. Remember... this is not only about Pit Bulls, as Breed Specific Legislation criminally discriminates against over 75 targeted breeds."

Canes continued, "This ridiculous and inhumane ordinance has been here since 1989 and it's time to go! It is solely responsible for the confiscation and killing of thousands of innocent dogs. Family members, who are left with hefty fines ...grieving over their loss... without a logical explanation! "

Canes asks that supporters planning to attend the hearing "wear your MCABSL t-shirts or other attire showing your support for our cause. By all means be courteous and patient, as this 101 crash course on Dade and the legal arena for BSL, will surely be enlightening. Let's Rock The House For Them!"

Police Say its "OK" to Taser Family Pet

LAKEWOOD, OH (WOIO) - A family dog tasered by Lakewood police will remain at an Animal Shelter until his owner's early August court appearance.

Two women heard Otis the dog barking Saturday morning around 8:30AM and looked out their apartment window only to see the pup surrounded by several police officers.

The officers tasered Otis "like he was a grizzly bear," says witness Christina MacDonald.

MacDonald also said that "the dog was backing up defensively, as if he was saying stay away from me. He wasn't being aggressive in any way."

Otis' owner, Daniel Kier, claims his dog is "a Boxer, not a Pit Bull." The animal warden agrees with local authorities and claims the dog looks as though he has Pit Bull in its blood.

Lakewood Police issued a press release that stated the dog was aggressive towards the officers and stand behind the decision to taser the dog.

According to Captain Gary Stone, the officer "observed an aggressive pit bull on the sidewalk, it charged at the officer and then stopped five feet away. The officer was then able to deploy his taser which incapacitated the animal."

Kier was cited for having a dangerous and vicious animal and for letting Otis run loose. He's scheduled to appear in court on August 4th at 9AM.

Otis will remain at the shelter until that time.

However, there is a vicious dog hearing for Otis at Lakewood Municipal Court at 3PM tomorrow afternoon. Pit Bulls are banned in the City of Lakewood.

Controversy surrounding Stu the dog spurs proposed change in L.A. animal law

After almost four years in custody, ten year-old Stu remains in legal limboIn their first meeting since the Court of Appeals ruled the death sentence against the long-incarcerated dog Stu could stand, the Board of Animal Services Commissioners on Monday proposed changing L.A.'s Municipal Code to allow the Board to overrule the General Manager's verdict of death against dogs the Animal Services department has determined to be dangerous, even after the appeals process has been exhausted, if new evidence becomes available.

Board Vice President Kathy Riordan pushed for strong action from the Board, both in a last-ditch attempt to ensure that ten year-old Stu not be killed in the wake of the Appeals Court decision, which would allow L.A. Animal Services to euthanize the dog as early as July 23rd, and to help avoid similar situations from occurring again.

Said Riordan, "Hopefully we can fix some things for future dogs with this."

Riordan introduced the motion after a lengthy closed session which followed a contentious start to Monday's meeting that was dominated by questions from members of the community about Stu's fate. Several people spoke in the senior dog's defense, including Orange County veterinarian Dr. Paula Terifaj, who asserted that although in her practice she has been bitten several times, occasionally severely, it is not customary to classify dogs who bite when fearful or in pain as dangerous. The single bite incident in which Stu was involved took place when the dog had been injured in a fight with another dog. The bite victim had attempted to put a harness over the dog's injured ear, an act that one expert said had inadvertently provoked the dog to bite.

Dr. Terifaj also pointed out that by the city's own established criteria for determining dogs as dangerous, Stu did not qualify when personally assessed by Dr. Richard Polsky, the animal behavior specialist who helped formulate the criteria over twenty years ago.

As the City Attorney proposed going into closed session, during which members of the public would not be present, Commissioner Archie Quincey initially objected, saying, "There are quite a few things I would like to say regarding this case that I think the public should hear. These are important issues and we seem not to be able to get any results."

Quincey went on to point out that despite repeated requests from the Board that Assistant General Manager Linda Barth provide all records related to the case, "We don't have them."

"Where are the records?"

Quincey, who brings thirty years of L.A. animal control experience to his role as Commissioner, pointed out, as he has done in previous Board meetings, that multiple discrepancies and omissions exist in the the incomplete records that the Department has provided.

"The bite occurred on August 12 and the dog showed up in the shelter on September 15." But, Quincey said, the records don't show how the dog came to be in City custody. "Where was the dog for thirty-four days? Officer Marino said the dog was impounded for a leash violation -- [but] no one will tell us how the dog came to be in the shelter. And then the next day the victim files the [bite] report. That is mighty coincidental!"

Since the Department could not document how Stu came to be in the shelter, when he had been housed in a locked kennel on owner Jeff de la Rosa's property, Quincey said, "As far as I'm concerned, the dog was brought into the City kennel illegally."

RSPCA Speaks Out Over Death Row Dog, Bruce

The RSPCA has added its voice to the growing outrage over the treatment of death row dog, Bruce, in Northern Ireland. The UK's largest animal welfare charity said:

It is wrong that an entire breed of dog should be banned purely on the basis of its genetic make-up, without any consideration of an individual dog's characteristics and temperament. (cont.)

The Dangerous Dogs (Amendment) Act 1997 was introduced in England and Wales so that the automatic death sentence on all pit bull type dogs was lifted. If Northern Ireland had adopted this amendment, many family pets identified as being pit bull types would be allowed to live out their life with their owners in accordance with the law. They would not be forced to spend their final days in kennels before being inevitably destroyed.

The RSPCA continues to campaign for the government to reassess its current dog legislation and shift emphasis from the four legs at the end of a lead to the two legs at the other. We want irresponsible owners to be held accountable for their actions, not their dogs

Bowser did nothing but go to a animal clinic to get "fixed". The clinic decided that Bowser was a pit bull PUP, called animal control and "reported" him to same. Now another owner is in the fight of his life to save his family friendly dog.

Today is Bowser big 1st Birthday and just wanted to give everyone brief update I still have Bowser in my possession they haven't taken him away. I had made few court appearances nothing major in court yet until my big trial date that is going to be schedule sometime in 2010.

Most of you are wondering what animal vet clinic is the one that made the complaint to animal controls, my lawyer advise me not to give out the vet name and location because I know a lot of people are angry at them for doing such a horrible thing , if people were to send hate mail or make calls people might be charged with criminal harassment and hurt my chances in Bowser court trial. In time they will show their faces to the public and everyone will know all about them.

Thank you everyone once again I'll be celebrating Bowser Big 1st Birthday today, Bowser a healthy happy fine dog can't be any happier. I'm keeping my chin up through this bullshit and hope for the best In the future. So please still support Bowser and wait for another update In the future.

From Sully: As a canine trainer and people instructor I have seen it all. I train any dog and any breed and this is what trainers are supposed to do. I train, I do not treat. I educate humans in the canine world and this allows the dogs a chance in our world.( Respect and training and team work.) I have many pit bulls in my classes and they are never a problem. I have many Doxy’s in my classes and 8 out of ten think they should be kicking some dogs butt as the pit bull will just look on and wonder what all the commotion is about.? It is not the breed that needs to be put down but the handlers that need to be educated. Owning a canine is a responsibility that requires some education prior to purchasing. You wouldn’t give your kid the keys to the car without first teaching him how to drive, would you? If you answered yes, then you shouldn’t have a dog or a kid. Let’s deal with the issue here.. Most canines are people pleasing and willing to learn if educated? So, educate! Educate yourself and the canine.
I have found that people treat a canine like it was a human and this is where the trouble starts.
Bruce should be brought home as he has done no wrong. In fact, there is a Search and Rescue canine that looks exactly like Bruce that goes out into disaster areas and saves human lives. This beautiful canine is known as Chico man. He was found in the street and with help and guidance, educated to help the human race in times of disaster….Yes he is of the Bull terrier breed or better known as a pit bull…a truly magnificent animal and true to his breed. Devoted and willing to give his life for another…need I say more?
Education is the key here for both human and canine. Poor Bruce looks like hell with his nose all chewed up and his tail infected. Who is in charge of this dogs well being anyways?
Bring Bruce home and educate people in the canine mind and world, so we can all live in harmony. If people are cruel then punish them to the fullest for animal abuse. Education is the key to solving problems prior to the problems beginning.
Bruce has committed no crime so he should not have to live like a criminal.
Until Bruce has done something wrong, let him live.

You may remember the links I sent to the videos of Bruce's story, well court date came on Monday 29th and Bruce's owner Shannon has posted the sad, despicable news that the judge has ordered that Bruce be put to sleep on Monday. How could the judge have ordered Bruce's death after all he and his family have been through? Here is the link, below, to Bruce's Bebo group where Shannon posted the news 11 hours ago. I will be telephoning David Brown on the numbers Shannon has posted tomorrow and I hope to find out more, please do the same if you can and I'm hoping between us if we share this news quickly and get some details to International media, TV stations etc., we might make a breakthrough to save this innocent dog's life. He has done nothing wrong and he has suffered immensely simply for being born a bully breed of unproven origin. Bruce even had a rescue place waiting at a shelter specialising in bully breeds. BSL FAILING GLOBALLY

Does appearance determine personality?

After almost six years of costly enforcement of breed specific
legislation, (BSL) Italy has lifted its breed ban and is replacing it with
a law that will hold owners accountable for their dogs. In September of
2003, Italy placed into effect laws that banned or restricted 92 breeds
including not just controversial breeds such as the Rottweiler and Pit
Bull, but breeds such as the Corgi and Border Collie. Italy later dropped
the deemed dangerous list to 17 breeds, and just this past April, removed
the restrictions all together. In light of the new law, Health
Undersecretary, Francesca Martini said “This is a historic day because we
have established for the first time the responsibility of the owner or the
person who is momentarily in charge of the animal.”

Dog advocates and experts globally have argued that dogs are individuals
and aggression cannot be pinned on specific breeds as a whole. Many share
the thought that banning an entire breed is nothing but a costly band-aid
fix to quiet the hype caused by the media. Until owners are held
responsible for their negligence, incidents will continue to occur even if
specific species are eradicated.

Possibly following suit to Italy’s new reversal on BSL, the United States
Court of Appeals for the Tenth Circuit has ruled in favor of an appeal
challenging the constitutionality of the Denver, Colorado breed ban, which
currently restricts owners with American Staffordshire Terriers, Pit
Bulls, American Bull Dogs, Staffordshire Bull Terriers, and dogs that
appear to be mixed with the listed breeds. Since the Denver ban was
re-enacted in 2005, over 1,000 dogs were subsequently euthanized. In their
decision, the Tenth Circuit Court is quoted to say "with its affections
for its friends, and children in particular, its off-duty quietness and
trustworthy stability, [the Staffordshire Bull Terrier is] a foremost
all-purpose dog."

In 1988, in Dade County, Florida, a breed ban was enacted. In 2002, it was
estimated that over 50,000 of the banned breeds were residing there.

In 2001, Baltimore, Maryland spent an estimated $750,000 just to enforce
breed specific legislation. Unbeknownst to many tax payers, BSL is very
costly. Examples are given using the Economic Impact Calculator.

June 9th, 2008, Holland lifts its breed ban against Pit Bulls after
discovering that fifteen years of BSL did not decrease the number of dog
bite incidents. After euthanizing many puppies that had Pit Bull
appearances, they concluded that physical traits did not pre-determine
temperament.

Ignoring statistics and efficacy of BSL, Canada remains firm on their
stance to ban specific breeds. On June 9th, the Supreme Court of Canada
refused to hear the appeal to remove their ban on Pit Bulls. In 45 years,
there had only been 1 reported fatality resulting from a “Pit Bull” attack
in Canada, out of 47 cases of fatalities involving at least 100 dogs, most
of which were sled dogs. The one listed incident was the result of
provocation by a drunken roommate.

Charlotte currently does not enforce breed specific legislation with the
exception that Pit Bulls and Pit Bull mixes cannot be adopted from the
Charlotte Mecklenberg Animal Care and Control, (CMACC) Facility. Members
of the rescue community are trying to help present solutions to change the
city legislation preventing their adoption, without putting the dogs in
danger of being adopted by fighters.

In hopes to provide more than a band-aid fix, programs to promote
responsible ownership are sprouting throughout the country in an effort to
help with breed discrimination caused by negligent owners.
